Is a Motorcycle DUI Different From a Car DUI in Maryland?

Does Maryland Use the Same DUI Law for Motorcycles and Cars?

Maryland Transportation Article § 21-902 makes it illegal to drive while impaired by alcohol. This law applies to all motor vehicles, including motorcycles.

The legal limits are the same for cars and motorcycles. A BAC of .08 or higher can result in a DUI charge. Even with a lower result, other signs of intoxication may support the same accusation. A reading of at least .07 but below .08 can support a DWI charge. When the reading is above .05 but below .07, the court may consider it along with other evidence, but it does not prove impairment by itself.

The penalties are also the same. A first DUI conviction can result in up to one year in jail, a fine of up to $1,000, and 12 points on the person’s driving record. The Maryland Motor Vehicle Administration may revoke the person’s license for up to six months. Separate administrative consequences may arise from a chemical-test result or refusal.

How Is a Motorcycle DUI Stop Different From a Car Stop?

Police officers are trained to look for specific signs of impairment in motorcycle riders before they pull someone over. Officers watch for things like weaving, difficulty staying in a lane, sudden changes in speed, and problems braking.

During the stop, an officer may tell you to get off your motorcycle or remove your helmet. The officer may watch how you stop, balance the motorcycle, get off the bike, follow directions, and handle your riding gear. The prosecutor may later use these observations as evidence.

There are three main roadside tests police use to check for impairment. These are called field sobriety tests:

  • The HGN test: The officer moves an object slowly in front of your eyes and watches how your eyes follow it.

  • The Walk-and-Turn test: You walk heel to toe in a straight line, turn, and walk back.

  • The One-Leg-Stand test: You stand on one leg while counting out loud.

Police generally give motorcycle riders and car drivers the same field sobriety tests. However, riding boots, heavy clothing, injuries, fatigue, bad weather, medical problems, or an uneven road may affect your performance. What Should I Do if I Am Charged With a DUI in Maryland?

The first thing to do is stay calm and do not say more than you need to. Anything you say after an arrest can be used against you in court. You have the right to remain silent, and you should use it.

Make sure you understand which breath test the officer is requesting. A roadside breath test is different from the chemical test usually offered after an arrest. You may refuse roadside field sobriety tests without receiving the same automatic license suspension that can follow refusal of a post-arrest chemical test. However, refusing these roadside tests may not prevent an arrest. The officer may rely on other observations when deciding whether to arrest you.

Write down everything you remember as soon as you can. Include where you were stopped, what the officer said, and what tests were asked of you. Write down what gear you were wearing and what happened during the stop. These details may be important later.
